A settlement has been proposed in a class action lawsuit filed in the United States District Court for the Eastern District of Arkansas. The lawsuit alleges that Wal-Mart discriminated against African-Americans on the basis of race in recruiting and hiring over-the-road truck drivers in Wal-Mart’s private fleet. Although Wal-Mart denies the allegations, the parties have agreed to a settlement.

Wal-Mart has agreed to pay $17.5 million into a Settlement Fund. Payments of Class Members claims, attorney fees and expenses, and costs of administering the Settlement will be paid from the Settlement Fund.

The Court has preliminarily approved the Settlement and has certified the Class. Final approval of the Court will be issued after the Fairness Hearing, which will be held on June 30, 2009, at 9:30 a.m. in the United States District Court for the Eastern District of Arkansas, 500 West Capitol Avenue, Little Rock, Arkansas 72201.

You may be a member of the Class if you are an African-American person, residing in the continental United States of America who:

  • Applied for employment as an over-the-road truck driver at Wal-Mart on or after June 22, 2001 and received notification of rejection of employment on or after September 22, 2001.

    OR

  • On or after September 22, 2001 was deterred or discouraged from applying for a position as an over-the-road truck driver at Wal-Mart.

Class Members have the following options:

  • Submit a Claim Form and receive a payment and give up the right to sue Wal-Mart individually.

  • Opt out of the Settlement Class; receive no payment but keep the ability to sue Wal-Mart individually.

  • Remain in the Settlement Class and object to the terms of the Proposed Settlement.
